Abstract

This article analyzes the intersection between social control, criminal law, and the use of new technologies in the information society. From a critical-methodological approach, it investigates how technological tools, such as artificial intelligence, facial recognition, and predictive policing, have reconfigured the dynamics of surveillance and punitive control. The main objective is to understand how the digitalization of social control affects fundamental guarantees and enhances the selectivity of the criminal justice system. The research, of a bibliographic and documentary nature, demonstrates that the transition from a classical disciplinary model to diffuse algorithmic control creates a 'digital panopticon', in which massive data collection acts as a mechanism for the prevention and repression of conduct. It concludes that, although technological innovations offer promises of efficiency in public security, they frequently reproduce discriminatory biases and operate outside due process of law, requiring a rereading of criminal dogmatics and the construction of strict ethical-legal limits to contain the advance of technological authoritarianism
