Environmental Justice in Institutional Discourse: analysis of the scientific production of the EMERON Magazine on socio-environmental conflicts in Rondônia

Abstract

This article analyzes the scientific production of the Revista da Escola da Magistratura do Estado de Rondônia – EMERON regarding socio-environmental conflicts in the Amazonian context, examining its interface with the theoretical foundations of environmental justice. Starting from the observation that the Amazon constitutes a space historically marked by territorial disputes, economic expansion and structural inequalities, the study seeks to understand how the regional legal-institutional discourse constructs and interprets such conflicts. The research problem consists of investigating how EMERON Magazine publications address environmental conflicts in Rondônia and to what extent this approach dialogues with the distributive perspective of environmental justice. The research adopts a qualitative approach, of a descriptive-analytical nature, based on documentary analysis of issues nº 29 (2021), nº 31 (2023), nº 32 (2023), nº 33 (2024) and nº 34 (2024) of the aforementioned magazine. The selection of articles was carried out based on the descriptor “environmental justice”, as well as texts that deal with socio-environmental conflicts, environmental protection, large enterprises, land regularization and protection of traditional communities. The technique used was thematic content analysis, allowing the identification of categories related to the legal-normative approach to conflicts, the presence of vulnerable groups and the incorporation of the distributive dimension of environmental justice. The results indicate a predominance of a formal legal approach, with an emphasis on constitutional interpretation and normative instruments for environmental protection. Although there is recognition of impacts on traditional communities and indigenous peoples, the explicit incorporation of environmental justice as a structuring distributive category appears limited. It is concluded that the EMERON Magazine constitutes a relevant institutional space for reflection on socio-environmental conflicts in Rondônia, demonstrating a commitment to environmental protection, but still has the potential to deepen the critical and distributive dimension of environmental justice in the regional legal discourse.

She served as Special Advisor in the Personal Office of the Presidency of the Republic, performing all functions inherent to advising, carrying trust and preparing pre/post-hearing briefings. Professor at PCI - Masters in Criminal Law at the Faculty of Law of the State University of Rio de Janeiro (UERJ). He worked as a Collaborating Professor at the European University of Madrid; Professor at the Federal University of Rondônia and the School of Judiciary of Rondônia - EMERON.
